TERMS AND CONDITIONS
The Terms and Conditions constitute a legally binding Agreement concluded between the Organizer of the Tour and the Participant of the Tour. By making a reservation for a Tour, you accept the provisions of these Terms; therefore, please familiarize yourself with them for your own peace of mind and safety.
§I. DEFINITIONS OF THE MOST IMPORTANT TERMS USED IN THE AGREEMENT
Terms and Conditions – these Terms also constitute the Agreement for Participation in a Tour concluded between the Booking Person and the Organizer and define its conditions.
Organizer – Watermelon Tours Zante, a travel agency with an official license to conduct tourism activities issued by the Greek Ministry of Tourism E.O.T. under number: 0428E70000214901, with address: ΡΩΜΥΡΙ 29-100 Δ.Ε. ΑΡΤΕΜΙΣΙΩΝ ΖΑΚΥΝΘΟΥ, Tax Identification Number / ΑΦΜ: 171545528, insurance policy number 10389742, email addresses: info@watermelon.gr, contact phone number +306976938277 website: www.watermelon.gr, and Facebook page (also Messenger) titled “Watermelon Tours Zante”, owned by Adam Andrew Stokowiec.
Booking Person – a natural person who has made a Reservation and thereby concluded the Agreement with the Organizer on their own behalf and on behalf of all other Participants listed in the Reservation.
Participant – a natural person whose data has been provided by the Booking Person during the Reservation process and who has thereby concluded the Agreement with the Organizer, as well as any person included in the Reservation who physically participates in the Tour.
Tour – a short-term tourist trip taking place on the island of Zakynthos or Kefalonia, as well as in other regions of Greece, organized by the Organizer for Participants. Tours do not last longer than 24 hours and do not include accommodation; therefore, the provisions of Directive (EU) 2015/2302 of the European Parliament and of the Council of 25 November 2015 on package travel and linked travel arrangements, nor the Greek Presidential Decree αριθ.: 339/96, shall not apply. Tours may be of any type: land-based, sea-based, coach-based, and shall be carried out according to the Original Tour Program.
Original Tour Program – a sightseeing method created by the Organizer, protected by copyright, published on the Organizer’s website. It also includes knowledge, the manner of its delivery, as well as the organization and execution of the Tour. The Organizer charges a fee for making it available to Participants at a specified date and time and issues an appropriate receipt. The program also includes Additional Paid Activities and Additional Paid Attractions.
Additional Paid Activities – voluntary activities included in the Tour program and included in the Tour Price.
Additional Paid Attractions – attractions included in the Tour program but not included in the Tour Price.
Tour Leader – any person who, on behalf of the Organizer, performs activities related to the execution of the Original Tour Program, e.g., guides or company representatives.
Minimum Number of Participants – the number of Participants required for the Tour to take place. Information about this is provided later in these Terms.
Price List and Information – the most important excerpts of these Terms concerning the rights and obligations of the Organizer and Participants, available on the website.
Reservation Confirmation – a document with an individual reservation number sent by the Organizer via email, indicating that a specified number of places for selected Tours are reserved for 72 hours, i.e., until the deadline for payment of the Deposit / Full Amount expires.
Price / Tour Price / Standard Price – the total monetary amount for participation in the Original Tour Program and Additional Paid Activities, which the Booking Person shall pay no later than at the start of the Tour.
Package Price – the Standard Price reduced by an amount determined by the Organizer when the Booking Person makes a Reservation for more than one Tour.
Deposit – a contractual part of the total Reservation amount, which the Booking Person shall pay within 72 hours of receiving the Reservation Confirmation.
Full Amount – the total amount for the Reservation, which the Booking Person shall pay by the start of the Tour.
Remaining Balance – the amount remaining after deducting the Deposit from the Full Amount, paid by the Booking Person to the Tour Leader in cash, in euros.
Payment Details – the bank account number provided by the Organizer in the email sent together with the Reservation Confirmation.
Execution Date – the calendar date selected by the Organizer on which the Tour is planned.
Price List – an indicative list of all Tour prices. The Price List may change and shall not be binding for the Organizer. The Booking Person has the right to retain the price from the date of Reservation even if the Organizer increases it; if the price decreases, the Booking Person shall be entitled to a refund of the difference, paid in cash in euros on the Execution Date by the Tour Leader.
Child aged 0–2 – a person who has not reached 2 years of age on the day of the Tour.
Child aged 2–12 – a person who turns 2 on the day of the Tour and all persons over 2 but under 12 years of age on that day.
Adult – a person who turns 12 on the day of the Tour and all persons over 12 years of age.
§II. ACCEPTANCE OF THE TERMS AND CONDITIONS
Making a Reservation by the Booking Person shall be equivalent to a declaration that the Booking Person has read and accepts the terms of the Agreement. The Agreement shall be deemed concluded at the moment when the Booking Person provides all data necessary to make the Reservation and after the Organizer sends the Reservation Confirmation.
Providing data of other Participants by the Booking Person shall be equivalent to declaring that each Participant has read and accepts the Terms.
Termination of the Agreement shall require written form and may occur:
a) on the part of the Organizer due to:
– failure to pay for the Reservation by the Booking Person within the specified deadline,
– reasons beyond the Organizer’s control, such as weather conditions, natural disasters, insufficient number of Participants, inability to carry out Additional Paid Activities significantly affecting the Tour Program, etc.;
b) on the part of the Booking Person without providing a reason up to 72 hours before the Execution Date.
In case of doubts regarding the interpretation of these Terms, the Booking Person should contact the Organizer for clarification; however, the interpretation provided by the Organizer shall not be binding.
The provisions of these Terms shall not infringe consumer protection laws applicable in Greece. If any provision of these Terms contradicts mandatory consumer protection laws, that provision shall not bind the Participant, and the relevant provisions of Greek law shall apply instead.
All information about the Tour published in social media, including Messenger and WhatsApp, brochures, promotional materials, or similar documents is for informational purposes only and shall not constitute part of these Terms or the Agreement.
Descriptions on the Organizer’s website are illustrative only and do not constitute a commercial offer. The only binding document is these Terms.
The Participant acknowledges that photos of landscapes or monuments presented on the website or in promotional materials are illustrative and may differ from actual conditions due to weather, lighting, or other circumstances.
§III. MAKING A RESERVATION
1. Obligations of the Booking Person:
a) The Booking Person shall be at least 18 years old to make a Reservation.
b) The Booking Person shall be the first person listed in the Agreement, and their data shall appear on the Reservation Confirmation and all booking documents.
c) By making a Reservation, the Booking Person concludes the Agreement on behalf of all other Participants and declares that they have read and accepted these Terms.
d) The Booking Person shall be responsible for making all payments for the entire Reservation (for themselves and all Participants) in a single transfer made in their own name.
e) The Booking Person shall be responsible for maintaining contact with the Organizer until all Tours included in the Reservation are completed.
f) The Booking Person shall inform all Participants about the meeting time and shall confirm receipt of the SMS with the meeting time in writing on the same day by 22:00 at the latest.
g) The Booking Person shall also be a Participant; if not, they shall inform the Organizer and appoint another Booking Person who will participate and assume their obligations.
h) The Booking Person shall inform all Participants that on the day of the Tour they must have valid health insurance.
2. A Reservation may be made via:
a) completing the reservation form on the Organizer’s website;
b) sending a request via email;
c) phone call or SMS, including WhatsApp;
d) Messenger via the Organizer’s Facebook page;
e) phone call to the Organizer.

The above actions shall not constitute a Reservation if they remain unanswered by the Organizer. A Reservation shall become an Agreement only when confirmed by the Reservation Confirmation with an individual number sent by email.
4. Personal data required:
a) full name of the Booking Person;
b) phone number active during the stay in Greece;
c) email address;
d) accommodation details (hotel/apartment/location);
e) number of Adults;
f) number of Children aged 2–12;
g) number of Children under 2;
h) names and dates of birth of all Participants;
i) selected Tours;
j) arrival and departure dates;
k) preferred Tour dates.

The Organizer may request proof of age (e.g., ID). Providing false information may result in refusal of participation. The Booking Person declares that all data provided is accurate and corresponds to official documents.
6. Legal basis and reservations:
a) Data is required for safety and legal reasons.
b) The Organizer reserves the right to refuse a Reservation for one person without providing a reason (e.g., for safety considerations).
c) The Organizer may inform the Booking Person within 30 minutes about lack of availability due to a system error and propose an alternative date.
7. Personal data processing:
The Booking Person and Participants consent to the processing of personal data. The Organizer is the data controller. Data shall be processed solely for reservation purposes. Participants have the right to access and correct their data. Providing data is voluntary but necessary.

After making a Reservation, the Organizer may reserve places if available. Lack of availability may be communicated within 30 minutes, in which case the Booking Person shall be required to select another date.
§IV. PAYMENTS
After making a Reservation, the Booking Person shall check the inbox of the email address provided during the Reservation in order to read the email sent by the Organizer containing the Reservation Confirmation and Payment Details. The Booking Person shall also check the spam folder and immediately notify the Organizer if the above-mentioned message has not been received.
After making a Reservation and receiving the Reservation Confirmation, the Booking Person shall pay the Deposit / Full Amount specified in the email within 72 hours from the moment of receiving it (72 hours counted from 00:00 on the day on which the email was received) and shall send proof of transfer in PDF format.
If it is a weekend and generating a PDF is not possible, the Booking Person shall send a screenshot of the transfer confirmation and subsequently provide the PDF on the following Monday.
If the Reservation is made less than 72 hours before the Execution Date, the Full Amount shall be paid immediately after making the Reservation in the form specified by the Organizer, unless the Organizer decides otherwise.
The Booking Person shall be responsible for making all payments for the entire Reservation (for themselves and all Participants) in a single transfer made in their own name.
If the transfer is made by another person, the Booking Person shall provide that person’s full name when sending the payment confirmation.
If payments are made in more than one transfer, additional fees of EUR 10 (ten euros) per each additional transfer shall be charged and added to the Full Amount.
During the Organizer’s working hours (as indicated on the website), the Booking Person may obtain information regarding the status of their Reservation and additional information about the Tour via email, phone, Messenger, or WhatsApp.
Failure to pay the Deposit / Full Amount within 72 hours of receiving the Reservation Confirmation and failure to respond to a contact attempt by the Organizer (one phone call or one message via Messenger or one email) shall be equivalent to cancellation of the Reservation.
Accepted payment methods:
a) Reservations made in advance (before arrival at the destination) shall be completed by paying the Deposit via bank transfer in euros to the account provided in the Payment Details.
b) Reservations made less than 72 hours before the Execution Date shall require immediate payment via bank transfer after receiving the Reservation Confirmation.
After payment, proof of transfer shall be sent in PDF format. Screenshots or photos shall not be accepted.
If the transfer is not credited by the Execution Date, the Organizer shall have the right to collect the Full Amount without deducting the Deposit and subsequently refund the difference once the transfer is credited.
c) Due to limited availability, the Organizer reserves the right to require full payment at the time of Reservation and to settle the Full Amount on any day before the Execution Date.
d) Transfers may be made from any account (including Polish accounts), but only in euros. Instructions shall be provided together with the Reservation Confirmation.
e) Cash payments may be made only in euros to the Organizer or the Tour Leader.
In the case of bank transfer payments, the Deposit / Full Amount shall be deemed paid only when credited to the Organizer’s account.
Remaining payments (if any) shall be made to the Tour Leader unless the Organizer decides otherwise.
If the Deposit has been paid, it shall be deducted from the Full Amount.
If the Booking Person fails to pay the Full Amount before the start of the Tour, no Participant from the Reservation shall be allowed to participate.
In the case of cash payments, the Full Amount shall be deemed paid when the Tour Leader transfers the cash to the Organizer.
The Tour Price includes Additional Paid Activities, such as:
a) transport,
b) Shipwreck Bay cruise,
c) Blue Caves cruise,
d) turtle cruise,
e) ferry to Kefalonia,
f) farm visit,
g) tasting.
These activities are included to enhance the sightseeing experience.
The Participant acknowledges their inclusion in the Tour Program and understands that some Tours (e.g., the Kefalonia Tour) cannot take place without them.
The Organizer collects payment for these activities and transfers it to the respective providers.
The Organizer shall not be obliged to disclose contractual prices, as they constitute a trade secret.
Resignation from these activities shall not entitle the Participant to any refund or compensation.
Participants take part in these activities under separate agreements with third-party providers.
The Organizer shall not be responsible for their execution.
Responsible providers include:
– Anastis Trans A. Aktypis – transport
– Potamitis Bros Boat Trips N. Potamitis – Shipwreck Bay & Blue Caves cruises
– Sea Life Zante Tours – turtle & Marathonisi trips
– Chionis Tours – Kefalonia ferry
– Askos Stone Park – farm visit
– Lekkas Farm – tasting
Each provider shall be fully responsible for safety, execution, and issuing receipts.
The Tour Price does not include optional Additional Paid Attractions:
– Melissani Lake (Kefalonia),
– Drogarati Cave,
– Askos Farm.
These attractions are optional and paid during the Tour.
Participants may opt out without cost; however, no refund shall be granted after purchasing group tickets.
The Organizer issues receipts only for services directly provided (Original Tour Program).
The Organizer shall not be obliged to issue receipts for Additional Paid Activities or Attractions — such receipts shall be obtained directly from the providers.
§V. PRICE, PROMOTIONS, DISCOUNTS
The Price stated in the email containing the Reservation Confirmation shall be binding, and the Participant shall have no right to demand a reduction of the Tour Price.
During any promotion, the Participant shall be obliged to familiarize themselves with the applicable promotional terms and conditions. The relevant regulations shall be available on the Organizer’s website during the promotion period.
Promotions shall apply only to individual Reservations and shall not apply to group bookings organized upon individual request.
Promotions shall not apply retroactively and shall not affect Reservations made prior to the introduction of the promotion.
The Organizer may grant the Booking Person a special discount; the decision and its amount shall always be determined at the Organizer’s sole discretion.
The Organizer shall have the right to introduce discounts if the Booking Person reserves more than one Tour. In such cases, the Standard Price shall become the Package Price.
Promotions, discounts, and rebates shall not be combined.
§VI. PARTICIPATION OF MINORS
A minor (i.e., a person under 18 years of age or otherwise lacking full legal capacity) may participate in the Tour provided that:
a) their parents (this term includes one parent or another legal guardian) give consent for participation in the Tour. Such consent shall be given by concluding the Participation Agreement on behalf of the minor.
If the Agreement is concluded by a person other than the Parent and the Parent does not participate in the Tour together with the minor, written parental consent shall be required, indicating the person who will take care of the minor during the Tour.
Preparing the written consent shall be the responsibility of the parent, providing it shall be the responsibility of the Booking Person, and the person supervising the minor shall carry it throughout the Tour.
b) the minor’s health and physical and mental condition allow participation — full responsibility shall lie with the parents or legal guardians.
Parents/guardians shall be responsible for the behavior and safety of the minor (as well as other persons requiring supervision) during the Tour.
They shall be obliged to supervise the minor, inform them about compliance with these Terms, safety rules, common sense, legal regulations, local customs and etiquette, and in particular about the legal prohibition of alcohol and drug use.
Any offenses committed by the minor or negligence by the parents/guardians that may lead to danger to life or health or violation of these Terms shall be subject to the provisions of the Criminal Code applicable in Greece.
In the event that a minor causes any damage, including violations of rights or property of others, full financial liability shall be borne by the parents/guardians.
The Booking Person shall inform the Organizer about the participation of a child by providing their date of birth during the Reservation.
The Organizer or providers of Additional Paid Activities/Attractions may verify the child’s age at any time and request documents (passport, ID).
The Organizer may make discounts conditional upon presenting such documents.
Eligibility for child discounts shall be determined by the child’s age on the Execution Date (not on the Reservation date or the date of conclusion of the Agreement).
The representative acknowledges that providing false information about a child’s age may result not only in refusal of discounts but also legal consequences, including penalties, fines, or contractual sanctions imposed by various entities.
All such costs shall be borne by the Booking Person.
The Organizer shall not charge fees for children aged 0–2.
Such children shall travel without their own seat and shall not be counted as seated passengers.
The parent/guardian may voluntarily pay for a seat at the price applicable to the 2–12 category.
In such a case, the child shall receive a seat.
Providing a child seat or carrier shall be the responsibility of the parent/guardian, not the Organizer or the transport company.
If a seat is required, this must be reported during the Reservation.
These rules shall not apply to boats or ferries.
If a child aged 2–12 travels free of charge but a seat is required, this must also be reported; however, no additional fee shall be charged.
Children aged 2–12 who have paid (except in free Tours) shall be entitled to a separate seat in transport, including boats and ferries.
§VII. RIGHTS AND OBLIGATIONS OF THE PARTICIPANT
Each Participant shall be obliged to have valid health insurance on the day of the Tour, preferably confirmed by presenting the EHIC card. The Participant may independently obtain additional insurance covering medical costs, accidents, or extreme sports by concluding an agreement with an insurer of their choice.
The Participant shall, prior to participation in the Tour, verify their state of health in order to determine that it allows participation. By participating in the Tour, the Participant declares that their health condition allows participation and that they have no contraindications.
The Participant shall independently decide whether vaccinations or allergy tests are necessary. It is strongly recommended to consult a doctor if any concerning symptoms occur before or on the day of the Tour.
The Participant shall comply with applicable laws (including local laws), these Terms, local customs and etiquette, as well as general safety rules and common sense.
A pregnant woman wishing to participate in the Tour shall consult a doctor before making such a decision. By participating, she declares that there are no contraindications.
The Organizer shall not be obliged to inform about potential health risks in such cases. The Participant shall bear full responsibility for participation.
During the Tour, the Participant shall follow the instructions of the Tour Leader and all signs and notices. The following are strictly prohibited:
a) leaving the group without permission;
b) sightseeing independently without supervision, approaching cliffs, precipices, or roads intended for vehicles;
c) jumping into water or swimming in prohibited areas;
d) consuming alcohol (except small tastings provided in the program) or drugs;
e) smoking outside designated areas;
f) swimming under the influence of alcohol or drugs;
g) excessive sun exposure without protection;
h) swimming by non-swimmers;
i) failure to follow safety rules or instructions;
j) moving through dangerous or unauthorized areas;
k) endangering the life, health, or property of others;
l) insulting or harassing others;
m) recording or sharing information provided by the Tour Leader.
Violation of the above may result in exclusion from the Tour without refund and return at the Participant’s own expense.
The Participant shall carry a valid identity document. Lack of such a document may result in legal consequences, for which the Organizer shall not be responsible.
The Organizer shall not be responsible for legal issues caused by the Participant, including violations of laws, alcohol or tobacco regulations, or the transport of prohibited goods.
The Organizer shall not be obliged to provide legal assistance.
When entering the water, the Participant shall assess risks such as depth, waves, boats, jellyfish, or sea urchins.
The Participant shall be solely responsible for assessing danger and shall do so at their own risk.
The Organizer shall bear no responsibility for accidents or death.
Participants suffering from motion sickness should prepare appropriately (e.g., medication, wipes, bags, water).
Vomiting in the vehicle shall result in a cleaning fee of EUR 40 (forty euros) per seat.
The Tour Leader shall not be obliged to provide such items and is strictly prohibited from administering medications.
The Organizer shall not be responsible for substances consumed during the Tour, including food and tastings.
The Participant shall be responsible for checking allergens.
The Participant shall travel in transport wearing dry clothing and using seat belts.
Smoking, alcohol, food, and open beverages shall be prohibited.
Contamination shall result in a cleaning fee of EUR 40 (forty euros) per seat.
The Participant shall use sun protection and appropriate clothing.
The Organizer shall not be responsible for sunburn or heatstroke.
The Participant shall wear appropriate clothing and footwear to protect against animals (e.g., snakes, insects).
The Organizer shall not be responsible for bites or stings.
Before swimming (especially in sulfur waters), the Participant shall remove jewelry.
The Organizer shall not be responsible for any damage.
The Organizer shall not be responsible for damage to underwater equipment.
Food and drinks shall not be included in the Tour Price.
The Organizer shall not be responsible for the quality of meals.
All recommendations shall be subjective and non-binding.
The Participant shall realistically assess their fitness and inform the Organizer about any health issues.
Skipping parts of the Tour shall not affect the Tour Price.
The Participant may transfer their rights and obligations to another person with the Organizer’s consent (assignment).
The Participant may withdraw during the Tour but shall arrange return transport at their own expense.
The Participant shall bear all rescue costs if required by law.
The Participant shall carry cash in the local currency.
The Participant shall comply with passport, customs, and health regulations.
The Organizer shall not be obliged to provide legal or translation assistance.
The Booking Person shall receive the meeting time via SMS on the day preceding the Tour after 21:00 and shall confirm receipt by 22:00.
Failure to do so may result in rescheduling.
Participants shall arrive at the meeting point at least 5 minutes in advance.
Late arrival shall result in exclusion without refund.
Repeated lateness (more than 3 times) may result in termination of participation without refund.
Violation of the rules may result in immediate exclusion without refund.
The Organizer may exclude a Participant before the Tour if they are under the influence of alcohol or behave aggressively.
Such behavior may be recorded and used in legal proceedings.
Recommended items include: camera, food, beach equipment, comfortable shoes, sunscreen, etc.
The Organizer may charge the Participant for any damage or misconduct.
In the event of disputes or unpaid obligations, the Organizer may report the matter to the police, which may result in restrictions on the Participant’s ability to depart (including potential flight restrictions).
§X. OBLIGATIONS OF THE ORGANIZER
The Organizer shall be responsible solely for the execution of the Original Tour Program, i.e.:
a) providing, during the Tour (excluding free time), a person speaking Polish;
b) organizing transport;
c) carrying out the route specified in the Original Tour Program and stopping at designated points for the time and activities provided therein;
d) providing knowledge about visited places in a clear and understandable manner;
e) providing knowledge about local customs, traditions, culture, and history;
f) ensuring that Participants arrive on time and at the appropriate place to take part in Additional Paid Activities / Attractions;
g) performing all activities related to the Reservation and providing all necessary information about the Organizer’s operations until the completion of the last Tour.
The Organizer shall not be responsible for:
a) any actions or omissions on the part of the Participant, especially when violating these Terms;
b) force majeure events, including but not limited to:
– natural disasters (tsunami, earthquakes),
– extreme weather events (tornadoes, cyclones, storms, floods, fires, landslides, lightning, hail),
– social disturbances (wars, terrorist attacks, riots, strikes, protests, road closures, etc.);
c) actions or omissions of authorities, including administrative and maritime bodies;
d) road conditions, traffic, blockages, or logistical issues;
e) actions of police, military, or fire services;
f) incorrect navigation (e.g., errors in Google Maps);
g) actions of third parties not participating in the Tour;
h) services not directly organized by the Organizer (e.g., rentals, water sports, excursions);
i) services provided by external companies (e.g., meals, tastings);
j) poor purchasing decisions made by Participants;
k) technical issues related to email delivery or devices;
l) failure to provide a valid contact number;
m) information from third-party materials not provided directly by the Organizer;
n) any other circumstances beyond the Organizer’s control;
o) any accidents, injuries, or death occurring during the Tour, Additional Paid Activities, or Attractions.
§XI. PARTICIPANT’S PROPERTY
The Organizer shall not be responsible for any belongings, documents, or personal items of the Participant, including luggage left in vehicles, public places, boats, restaurants, shops, or other locations.
The Participant shall always verify that all belongings have been collected before leaving any location, especially valuables such as documents, money, or electronic devices.
Lost items should be reported immediately to the Tour Leader and, in the case of lost documents, also to the local police.
If a lost item is found, the Organizer shall not be obliged to deliver it to the Participant. The Participant may collect it personally or arrange shipment at their own cost and risk.
The Organizer shall not be responsible for items left behind and does not guarantee their recovery.
§XII. CANCELLATION OF THE TOUR BY THE ORGANIZER
The Organizer shall have the right to cancel the Tour no later than on the day preceding the Execution Date due to failure to reach the Minimum Number of Participants, as well as at any time in the event of force majeure or other circumstances beyond the Organizer’s control.
In the event of cancellation for the above reasons, the Organizer shall offer the Booking Person an alternative date of the selected Tour or another Tour (with a different Program).
The Booking Person may accept the Organizer’s proposal (in which case no refund of the Deposit / Full Amount shall be due) or refuse it, in which case the Organizer shall refund the paid Deposit / Full Amount to the same bank account from which the payment was made.
The refund shall be made within 21 days from the date of the Booking Person’s decision.
If only some Participants from the Reservation decide to withdraw, the refund amount shall be calculated proportionally and returned to the Booking Person’s bank account.
Under no circumstances shall the Organizer issue refunds to a bank account other than the one from which the payment was received.
After the start of the Tour, the Organizer shall have the right to:
a) change the Tour Program, in particular by replacing specific points of the Program with others;
b) shorten the Tour Program;
without issuing any refund or compensation on that account.
Before the start of the Tour, the Organizer shall have the right to change the Price, Date, or Program of the Tour or to shorten it.
The Organizer shall notify the Booking Person by email, SMS, or phone, indicating the changes.
Within the time specified in the notification, the Booking Person may, by sending an email to the Organizer, accept the changes or withdraw from the Tour (termination of the Agreement).
Failure to respond shall be deemed acceptance of the changes.
In the event of withdrawal, the Organizer shall refund all payments made within 21 working days from the date of receipt of the withdrawal statement.
Under no circumstances shall the Organizer be liable for weather conditions or, in the case of a change of date, for weather conditions on the new Execution Date.
The Organizer reserves the right to change the Tour Program during its execution.
If the change concerns a cruise and it must be entirely cancelled due to weather conditions, the Booking Person shall receive from the Tour Leader a cash refund of EUR 5 (five euros) per person from the Reservation who has reached the age of 12.
The refunded amount is symbolic, as the reservation fees paid by the Organizer to providers of Additional Paid Activities are subject to trade secrecy.
The amount shall be non-negotiable.
§XIII. CANCELLATION OF THE TOUR BY THE PARTICIPANT
The Organizer shall have 21 working days to process refunds. Refunds shall be made only to the bank account from which the payment was received.
The Organizer shall not transfer funds to any other account, even if the cancellation concerns a Participant other than the Booking Person.
The Participant shall have the right to withdraw from participation (terminate the Agreement) before the start of the Tour by submitting a written statement (under pain of nullity) via email.
The refund shall depend on the timing and shall amount to:
– 100% if the cancellation is received more than 72 hours before the Execution Date;
– no refund if the cancellation is received less than 72 hours before the Execution Date.
The Participant may withdraw during the Tour but shall submit a resignation statement and arrange return transport at their own cost and risk, without the right to any refund.
The date of cancellation shall be the date on which the Organizer could become acquainted with the content of the statement.
If only some Participants cancel, the refund shall be calculated proportionally and returned to the Booking Person’s account.
The Booking Person may request a change of the Date or Participant up to 72 hours before the Execution Date.
The Organizer shall inform about the possibility of such change and any additional fees.
The Organizer does not guarantee the possibility of such changes.
If a replacement Participant takes over the obligations, no additional fee shall be charged (unless obstacles occur).
In cases of cancellation less than 72 hours before the Execution Date, a 100% refund shall be granted only if the Participant provides a valid medical certificate clearly stating inability to participate.
The certificate must:
– be issued by a doctor in the place of stay;
– be delivered by email by 21:00 on the day preceding the Tour.
Otherwise, it shall not be accepted.
The refund shall be processed within 21 working days.
If only a Deposit was paid and the Participant does not attend the Tour without a valid certificate, the Organizer shall pursue payment of the Full Amount amicably and subsequently through legal proceedings.
In the case of package Tours:
a) If no Tour has taken place:
Refund = Package Price – Standard Price of the retained Tour
b) If one Tour has taken place:
– more than 72 hours → partial refund;
– less than 72 hours → no refund.

§XIV. COMPLAINTS
Any reservations and remarks during the Tour should be reported by the Participant immediately to the Tour Leader.
Regardless of the above, the Participant may submit a complaint to the Organizer indicating deficiencies in the performance of the Agreement and specifying their request, within no more than 30 days from the date of completion of the Tour.
The complaint shall be submitted to the Organizer in writing to the email address: info@watermelon.gr. The date of submission shall be deemed the date of receipt in the Organizer’s email inbox.
The complaint shall be legible. If it is not possible to read the complaint, the Organizer shall request the Participant to resubmit it in a legible form. In such a case, the time limits for handling the complaint shall be suspended.
A properly submitted complaint shall include at least: the Participant’s details (name, surname, address of residence, email address, contact phone number), reservation number, and a concise description of the disputed circumstances together with justification.
The subject of the complaint may not concern activities, items, or other matters for which the Organizer is not responsible under these Terms.
If the Participant seeks reimbursement of costs incurred outside the Tour organized directly by the Organizer, the Participant shall present a receipt attached to the complaint. The receipt must include the type of service, time and date of issue, and the justification must be valid and consistent with these Terms.
If the claims fall outside the Organizer’s liability, the complaint shall be deemed unfounded and shall not be accepted.
The Organizer shall have 30 working days from the date of receipt (date of delivery to the office) to consider the complaint. Failure to consider the complaint within this period shall mean that the complaint is deemed accepted by the Organizer.
In the event of dissatisfaction with the outcome of the complaint, the Participant shall have the right to pursue claims in court. Any disputes shall be resolved by the competent Greek court.
If the rejection of the complaint or any other dispute results in the Participant engaging in harassment, threats towards the Organizer or its employees, posting unjustified one-star reviews, publishing defamatory content, or similar actions, such conduct shall be treated as intentional harm to the Organizer.
The Organizer reserves the right to collect evidence and initiate legal proceedings, including claims for defamation and damages.
§XV. HEALTH
The countries of the Mediterranean Basin are considered safe in terms of health. Mandatory protective or preventive vaccinations are not required.
However, basic hygiene rules should always be observed, such as washing hands before meals, washing fruits and vegetables, and drinking only water from a safe source.
Before travelling, it is recommended to check and follow current information for Polish citizens travelling abroad published by the Ministry of Foreign Affairs of the Republic of Poland.
§XVI. PERSONAL DATA
The Participant consents to the processing of personal data provided in connection with the conclusion and performance of the Agreement, including: name, surname, email address, phone number, bank account number, residential address, date of birth, identity document or passport number, by the Organizer for purposes necessary for proper performance of the Agreement, including execution of the Tour and the reservation procedure.
The Organizer shall have the right to transfer personal data to third parties (e.g., transport providers, museums, hotels, restaurants) where necessary for execution of the Tour Program.
The Organizer informs that:
a) it is the controller of personal data;
b) data is processed for the purposes of the Agreement;
c) the Participant has the right to access and correct their data;
d) providing data is voluntary but necessary. Deletion of data before or during the Tour shall be treated as withdrawal from the Agreement;
e) further information is contained in Directive 2002/58/EC and Greek Law No. 2472/1997.
§XVII. USE OF IMAGE
The Participant consents to the free use (publication and dissemination) of their image recorded during the Tour for marketing purposes.
If the Participant does not consent, they shall notify the Organizer in writing no later than the Execution Date.
§XVIII. SUMMARY
The Agreement is concluded in the English language.
The Organizer reserves the right to amend these Terms at any time. Changes shall take effect upon publication on the website.
In matters not regulated herein, Greek law shall apply, in accordance with Regulation (EC) No 593/2008 (Rome I).
Disputes shall be resolved amicably, and if unsuccessful, by the competent Greek court.
Invalid provisions shall not affect the validity of the remaining provisions.
These Terms enter into force on 1 January 2022.
The version of the Terms in force on the Execution Date shall apply, even if a previous version was in force on the date of conclusion of the Agreement.
